Guest Worker Program

Before we can have an acceptable Guest Worker Program we have two items.
1. A secure border
2. A sound complete and enforceable Guest Worker Program with “BITE”.

Issues accompanying illegal aliens, those that come here without government authority and those that refuse to leave after their documents expire.:

First and foremost is, if illegal aliens can walk across the border freely, so can the members of any terrorist group that will do us harm!
Illegal’s work “Under the table” Get paid in cash where no taxes are removed allowing the employer to pay them less.
Illegal’s not working under the table use false documents and in cases use American SS’# to obtain employment. This doesn’t reduce the amount the employer pays but increases the earning status of the person whose SS number they used, making them pay IRS more taxes on money they didn’t get.
Illegal’s working under the table also suppress wages Americans would be entitled to if they took the same job.
Employers hiring illegals aren’t required to provide worker’s comp insurance for them, deduct taxes and funds for social security.
Illegal’s that are unable to work for education, mental, or medical reasons attack our welfare system; Social Security, SSI, Food Stamps, General Relief to name a few.
Illegal’s have no allegiance to this country. They violated one law to be here and violate others to stay and participate in the American way of life. They purchase and drive cars with expired registration, no insurance and no license. They use false documents and use others SS#, they harm Americans and when sued for thousands they leave the country and comeback under a different name and ID’s.
We have no knowledge of who is here and how many they brought with them. Some are here to work, some here for benefits and others to harm americans They violated one law they don’t like they will violate all laws they don’t like
It will cost Americans billons of dollars to make our north and south land borders secure from all those that wish to A. Violate our laws on immigration, B. Do harm or death to Americans, C. Use our Constitution they wish to destroy for their own means, D. Destroy property belonging to Americans, private, corporations or the governments, city, county, state and federal.

We MUST put our money to best use to secure our borders. Canada has the Canadian Mounted Police and Military on its border, Mexico has police and the Military on its borders. We must do the same. We have laws on the books to accomplish this, Eminent Domain and the Patriot Act. Let us use this law for what it was intended for.

First it puts up a wall or security fence at the cost of the Department of Defense, bypasses the Posse Comitatus Act, by having the military on the border securing their base a task that is a requirement for all base commanders. Control the ingress and egress of this country by means that everyone would have to pass thru a Military Installation. The State Department, Homeland Security, NSA, Federal, State and local police will be able to know who left the country and who returned, simply by “Everyone” that leaves or returns MUST have an ID card to prove who they are, the parent will have a card for each child. Anyone entering a Restricted Military Installation without authority will be subject to the ways the Military handles things. As I stated to the depth of each installation 1/8th to ¼ mile means you would have an “Entrapment” area. Anyone who is not allowed to leave the country for legal reasons or kept out would be taken into custody. Additionally, US Border Patrol and National Guard can assist the military.

When I thought of this idea I also thought of after effects. The obvious is our border will be secure, also, wanted felons, those on parole, those wanted by law enforcement would be taken into custody. Those barren areas of the state would be developed, as we all know, where there is a military base, Americans will develop a town to provide services for workers on the base. Development of the area will also happen. Win, win, and win.

The next thing is the Guest Worker Program. This program must make available to all participants the option to become a citizen in 6-8 years provided they haven’t been convicted in breaking our laws. We know that illegal aliens pay taxes, but this is a half or less truth. Yes, they pay taxes, state sales taxes and taxes associated with utility services, Phone, Gas, Water, Cable. And if taxes are taken out of their pay those funds aren’t really accounted toward them because they used someone else’s social security number to get hired. This program MUST take Security, Safety, Accountability and Verification seriously.

This program I have developed will have verification as follows:

All illegal aliens have 2 choices, to sign up or refuse. Those that refuse to sign up and are contacted by the police and are discovered to be here illegally, will summarily deported. Those that sign up have a set of rules and procedures to follow. All those that sign up will be given a card much like a state ID cards and will be issued a number much like a social security number. This number will be easy to identify as not a social security card by the letters SW in front of the number. For example: SWXXX-XX-XXXX. This number would be used for tax, ID for the state they work in, employment purposes. It will contain their address where they live, name and license ID number of their employer, a coded number to gain access to DNA markers, blood type, finger prints, iris scan, and their picture. FICA taxes deducted from the GW SSN# will be equivalent percentage as Americans but will be placed in its own account as a GW Social Security. If a drivers license is made available to guest workers, the state will be the insurance agent and they will pay the state monthly for the privilege to drive a car in this country. Pay monthly or don’t drive, their choice.

Security: We will know thru this program who has come into this country in violation of the law, who they say they are and methods in which we can verify their statements. We will know where they live and work, when they leave the country and when they return and even though it allows them to continue to be here many constitutional rights American have are drastically limited to the guest worker.

Safety, The information gathered on the guest worker will make us all safer. By sharing information with all agencies means if this person is a criminal or is wanted that person can be taken into custody. Blood samples can be tested for diseases. Monthly acknowledgement by the guest worker will swear under penalty that they live at the address stated and they work for the employer stated. It will be made clear, any guest worker that violates or laws maybe summarily deported. Guest workers will not be entitled to own a firearm, vote, get state or federal aide or a driver’s license. A person that has no allegiants to this country and their own fails to meet the privileges, benefits and rights of a citizen.

Accountability: We must hold these people accountable, the guest worker and the employer. The guest worker will not be allowed entry to the program unless these requirements are met. The guest worker must name the state licensed employer and state how much they will be paid for their services. If this amount fails for meet the rule of self-survival they will be rejected and must find another employer. The guest worker wages must also meet the rule of survival for any guest of the guest worker and the guest must meet many of the rules for a guest ID card and the guest worker will be held accountable for their guest. The employer must monthly verify that the guest worker is under their employ and verify that they are being paid the amount stated by the guest worker. The employer must deduct ALL taxes and deductions that Americans pay in addition, provide medical and dental insurance for the guest worker. I know this will cost the employer more, but many employers would be better to hire Americans for the position and save. Any guest worker that violates any of these terms maybe summarily deported, or fined. Any guest worker that has their employment halted the guest worker and the employer must notify the program immediately and the guest worker will be given 30 days to find other qualified employment. If an employer fails to meet the requirement will pay a heavy fine as an employer that hires someone here illegally. Any guest worker that falls off the program and runs will be deported if any city, county, state or federal agency apprehends them.

Verification: We will have DNA, Fingerprints, Blood type, Iris Scan, Photos, Address where they will be living and name of the verified licensed employer. We will know when this person leaves the country and when they return. Anytime they use medical services their insurance will cover 80% of the bill which is better than nothing. Police and agents can visit their homes and places of employment to verify they are in compliance, if they fall off the radar and are found later they are gone.

Secure Our Borders

Securing our boarders in a post 9/11 world is paramount. How this can be done either State by State or by the Federal Government in the establishment and cost is debatable. There were two legal decisions that made it clear what is the best interest of the people, Eminent Domain and the Homeland Security Act.

Eminent domain is best served here in the securing of our boarders. I propose acquiring all property along our land boarders 300 feet to 300 yards. Then make this land a “Military Installation” this then falls under the budget of the Dept. of Defense. The Dept of Defense now re-aligns military bases within the bordering states to the bases land established along the boarder. All re-aligned bases will have equal distances along the state.

The military and US boarder Agents will control ingress and egress of this country, the 300 feet or 300 yards becomes an “Entrapment” area. Only those cleared by the military will be allowed to pass. Persons wishing to ingress or egress this country must have a valid Passport.

Homeland Security Act allows for all State and Federal agencies to communicate with each other. When a person submits an authorized document they will be checked by all agencies and only if the person isn’t barred or wanted by any justice dept. they will be allowed to pass. If they are wanted, they will be put in custody on the spot. This will also let the state dept. know when an American or foreign national enters or leaves the country and will help catch criminals attempting to leave or enter the country.

Re-aligning the military bases removes the cost from the states, re-vitalizes barren areas, no losses to the state and benefits the state to start a program I call “Project Last Chance” which helps the homeless obtain a skill to become part of the workforce, single parents get support to gain the skills to become employable reducing state AFDC costs 50% to eventually 100%. I will provide details on that on request.

Would you support an auto insurance plan that makes victims whole?

The plan would be the first to pay before any other insurance
you have for:

1. Repair or loss of your auto.
2. Car Rental while yours is getting fixed.
3. Doctor and hospital bills.
4. Prescriptions for injuries.
5. Lost earnings while under doctor care till he releases you.
TO THE LIMITS MANDATED BY STATE LAW

In addition this will:
A. Would allow “Guest Workers” to obtain a license.
B. Resolves the loss or repair of the auto by administrative actions.
C. Resolves the loss of earnings while under doctor care by administrative actions.
D. Resolves the cost of medical care by administrative actions.
E. Make the person whole financially to the limits mandated by state law.
F. Frees up the courts by reducing the court time in settling law suits.

This is how it’s done:

1. Require all licensed drivers to renew their license and info
monthly while paying for their monthly insurance
premium.

2. Would suspend or revoke the license after 30 days of non-
payment or information is found to be false.

3. Would allow for the confiscation of any auto under the
control of an un-licensed driver even if the car has a lien.

4. Will prohibit compensation by law of any kind to those who
have been injured in an auto accident caused by a licensed
driver to an un-licensed driver and to the driver of any car
not properly registered.

5. Would arrest an un-licensed driver accident or not. In the
case of an accident caused by the un-licensed driver, if
found guilty a mandatory fine of not less than the total
damages caused, plus court costs will be levied.

6. Drivers can get ancillary or additional private insurance to
extend their coverage, but are subject to the same
regulations as the insurance provided by the state.

Driving is a privilege and one who wishes to have this must follow the rules and regulations also two prerequisites.

1. Assumable Risk.

No matter how safe you drive, you may be involved in an accident. Licensed drivers will follow the rules of the road. If you’re involved in an accident you may be injured. Pain and suffering is an assumable risk. Example: You go to a baseball game and sit along the 3rd base line. A high foul ball is hit and you get hit in the head. You cannot sue for damages or pain and suffering because you waved that on getting the privilege to sit there and watch the game.

2. Accepted Risk

Is the risk someone takes when they willfully violate the law such as drive without a license or properly registered auto. This includes those that ride as a passenger. Person who intend to ride with a driver has the obligation to ask that the driver has a valid license. fot themselves and the car in order to accept the risk that are about to take.

The legislators approve measures that: Allow the State to be the carriers of auto insurance and cover to the limits set above.
Have the State Dept. of Insurance be the manager of this insurance. The additional funding for this can be acquired by the interest paid on deposited monies collected from the licensed drivers. Have the State Dept. of Insurance work and share information with the Dept. of Motor Vehicles invalidating, suspending, issuing, drivers licenses and in determining how much a licensed driver is to pay per month for the privilege to drive. Have these departments share and receive income verification from the State Tax Board to determine actual loss of income an injured party may have. In the case of someone un-employed or is under doctorcare they will be assessed at Minimum Wage standards. All license requests will be subject to the terms of registration. They must submit to Retina scans, Finger Prints and their home and work addresses. This they must verify is current every month under penalty of perjury.
Creates three basic coverage’s a licensed driver will have: Medical, Property damage and Loss of incomeProperty Damage. If the repair costs to the vehicle are under fair market value, and under $30,000 the state will pay the body shop directly for the repair. If the repair is above fair market value, the owner has choices. 1. To have the vehicle repaired and pay out of pocket the overage. 2. Salvage the vehicle and get a voucher from the state for the fair market value to be applied toward the purchase of another vehicle. If the person refuses to do either, they forfeit the loss.

All injured parties of an accident must use CountyMedical Facilities and State approved body shops. Out of state drivers and insurance will be required to follow the states rules while the driver is within this state.
Require private insurance companies follow and obey the standards set above. The state pays first to the limits of Medical,Property and Income loss to the injured party. Private insurance if they have any will cover amounts to their limits set. Raise the cost of a drivers license from $10 for 3 years to 50 cents to 1 dollar a month. This will pay for more DMV employees to handle the extra duties. This will virtually eliminate the need to settle losses by the courts and lawyers. Makes the injured party whole to the limits of total insurance carried. Sets a base for allowing for immigrants under the Guest Worker Program to register for a drivers license although their license will look somewhat different in color and design with a GW or IM in front of their number.
{This must be included to pass approval with the Governor}Supports our county hospitals and doctors by reducing financial losses. Insures that all licensed drivers have the basic minimum auto insurance coverage. Sets the requirements to limit excessive payouts and reduce fraud.

This insurance only covers to the limits established for the victim of the driver that caused the accident, not to the driver responsible for the accident.

Ancillary Auto insurance can be purchased to cover the 3 categories presented over and above these and areas not covered. But as to the 3 categories, the state insurance pays first to the limits if the limits set when verified.

If an unlicensed driver causes and accident or a licensed driver is driving an unlawfully registered vehicle causes an accident the vehicle driven will be confiscated and the driver arrested and cited with violation of state law. They will have a trial and if found guilty the sentence would be suspended until all damages have been totaled. The guilty person would then be fined by the court to the amount of damage caused up to $90,000 plus costs for trial. They must make agreement to make payments to the court and then they would be released. Failure to pay the fine means arrest and confinement till another promise to pay is made and followed. At some point they will not be release.

As a victim of an accident following the sample as above the unlicensed driver and / or the unlawful car would be confiscated in addition they will be precluded by law to seek any damages from the accident {Assumed Risk} The licensed driver would still have an accident attached to their record, but the insurance would not pay out.

If an insured driver caused the accident to an unlicensed driver / car The driver is cited and the accident is recorded, but the unlicensed driver cited, the car is confiscated and cannot seek claims for loss.

Once this is in place it sets the stage for possibly a"Pay at the pump" system, where a licensed driver would pay for their gas by using their drivers license to activate the pump where the state computer will determine how much the driver will pay for the gas based on the amount of "Risk" they are. For example: It would be determined that the average car gets 20mpg. That being said I buy 20 gallons of gas a month, that means I drive 400 miles per month. Bill buys 200 gallons a month therefore he drives 4000 miles per month. Each having no tickets or accidents and near same age who has the most risk? Bill is, he spends more time on the road than I do. Where I may pay a $2 per gallon insurance fee to my gas Bill may pay a $3-4 insurance fee added to his gas. By virtue of having a license and a car with gas we are insured. And this applies to any vehicle a licensed driver is driving.. If it has gas, it's covered.

Government Investment Plan


The billions of taxpayer dollars given or loaned to the banks have failed to stimulate the housing market as I expected. The reason it failed is because it let the very people that caused the problem to perpetuate it. For every billion dollars provided they used to 75% of the funds to; Give themselves pay raises, bonuses, use the funds for conferences in expensive 5-star resorts, buy smaller companies, refurnish offices, replace old cars with newer and more expensive ones, replace or purchase millions dollars company jets and so on. This left 25% to go to existing home owners and new home buyers that now require more scrutiny.

They have squandered their own funds and are using the billions to get it back and benefit. I have a better solution. My solution is a 2 phase plan that will benefit home owners and perspective home purchasers. It will invigorate the housing engineering industry, construction industry and real estate industry. My plan is not a give away to home owners facing foreclosure but it’s an investment with major restrictions that will help in the first phase to give those home owners a chance to keep their home to renters of homes facing foreclosure a chance to buy the home they rented, renters of apartment building facing foreclosure an chance to buy the apartment they rent and renters that have the need for 1-bedroom to 2-bedroom units a chance to buy that home for what they currently pay in rent. The housing engineering industry will respond by designing four plexes that consist of 1 and 2 bedroom units that will turn renters into home owners which spills over to property taxes for the state and counties, home improvements benefits to contractors or home improvement business. How it works is rather simple if these basic rules, qualifications and conditions are met.:

Government Investment Plan

PHASE 1

1. Qualifications Home Owner:

A: Home owner must currently be in the foreclosure process.
B: Home owner cannot be obligated to any other real estate or own and real estate even if paid for.
C: Home owner must be living in the home.
D: Home owner must be a legal resident of the USA.

2. Limits:

A: Home owners pending re-establishment payments under the Government Investment Plan monthly payment cannot exceed 30% of net pay plus more than $500.00.
(Home owners re-established mortgage payment at a reduce interest rate must not exceed 30% of net income per month plus not to exceed $500.00. If the re-established payment is 30% of net monthly income no further GIP applies. If it does, up to $500.00 per month will be covered by the GIP. If it all exceeds then the home does not apply under the GIP.

B: Acceptance of the Government Investment Plan means that the homeowner is prohibited from approval of any 2nd mortgage, equity lines of credit or any other process that would add financial liability to the property for anytime the investment funds are applied to the home purchase.

C: Home owner cannot be obligated to any Open loans such as Credit Cards, Car Payments or store accounts. Accounts that are established will be closed and precluded from reopening until the investment funds are returned, established car payments are accepted but re-loans will be restricted. Credit Reports will be annotated to prevent any further credit.

D: The GIP is a ONE TIME deal

3. Renters:

A: Must been living in the same unit for 2 years paying rent on time.
B: Building must be in the foreclosure process.
C: The buyer must be a legal resident of the USA
D: The buyer cannot be obligated to any other real estate or own and real estate even if paid for.

Limits

A: Buyers pending establishment of monthly payments cannot exceed more than 30% of net income plus up to $500.00 or $500.00 above what they currently pay in rent.
(If the buyer rent is 30% of their net, no GIP applies; if the buyer rent exceeds 30% the GIP will apply up to $500, 00 per month toward payments. The buyer will be held obligated to a monthly payment equal to their rent. If it all exceeds then the home does not apply under the GIP.)

PHASE 2

1 Qualifications of the buyer

A: The buyer must not own any other real estate.
B: The buyer will be living in the home.
C: The buyer must be a legal resident of the USA.

2. Limits

A: The buyer’s establishment of GIP cannot be more than $500.00 of their current monthly rental payments.
Phase 1 2B, 2C and 3A also apply.

ACTIONS:

When intervention is set forth the original property owner has lost possession of the property. GIP gets a stay to the remainder of the foreclosure process.
Subsequent actions will be to establish total payoff of the amount owed to the financial institution and what the monthly payment would be under a reduced interest rate.
If the established payment is $500.00 less than their current payment and they can afford “30% of net monthly income” to pay the new rate the requirement is met.
If the established payment is equal to or $500.00 greater than their current payment and they can afford “30% of net monthly income” to pay the new rate the GIP will apply up to $500.00 per month added to each established obligated payment made.
Previous home mortgage will be paid off by the Government Investment Plan putting those funds back in the hands of that mortgage holder. They lose any future interests gained. “Bad Behavior”
The property title now becomes property to selected mortgage companies ie: Fanny Mae, Freddie Mac, HUD. Those companies agree to the interest rate with the GIP and return the cash value back to the GIP and they are rewarded by future earnings from the interest. “Good Behavior”
All GIP monthly payment invested funds and interest will be put on the backside of the home loan and is only due and payable when either 1.The home owner wants off the program, 2. Sells the home, 3. The home is re-financed. Or 4. The home is foreclosed on due to home owner’s failure to make the minimum payment due. Interest paid funds will go back into the GIP
The monies provided by the Government Investment Plan will earn a set simple interest rate to be less than the mortgage rate “1% not to exceed the rate of the mortgage”



The GIP is not a give away and is a much smaller loan than that which has been squandered to the banks. Better controls are created and actual funds are returned with interest

Phase 1 is a plan to give a rescue to legitimate home owners a chance to keep their home. The Qualifications and Limits listed will help insure they don’t fail again.

Phase 2 is a plan to turn Renters into Home Owners. The Qualifications and Limits listed will help insure they don’t fail.

Home owners, landlords that have over extended themselves to the point of losing their property will lose all investment into that foreclosed property. “Bad Behavior” Mortgage companies giving “High Risk” loans will get what is due on the home and lose future interest profits “Bad Behavior”

Those lending institutions willing to work with the government will earn the interest off the loan “Good Behavior”

As a general habit most homeowners will purchase and sell a home in 5 years, some will last 10-15 smaller amounts will hold a home for 30 years so the GIP would get most of the investment with interest in 5 years and more than half in 10-15 years. These figures only count for home owners living in the home.

Look, Renters have to rent to stay where they are, be it an apartment or a house they pay that till they can no longer do so then move, but still, they have to rent somewhere. If home owners could keep their home with a $500.00 a month helping hand, lets do it. No vacant homes. If renters can buy a home under the plan they’d have the “Ownership” pride and get the same helping hand they’d take better care of what they got.

Those people can refuse the process, can buy their way out or sell to a new buyer under the plan. No unit would be vacant.

The winner is the American people. We turn defaulting home owners into responsible home owners and renters into home owners and property tax payers
